It's the same as turnig the ESP of on a Mercedes. Djeezes, that's why it's on the car.

When you turn the DSC off on a BMW, its really off right? On a Mercedes it simply raises the threshold but still intervenes in the end.

But I don't believe the best handling car in its class would fail the test. Somethings very wrong with that particular car or the test was somehow flawed.

I think the same. No matter wich car mag from wich country, wich driver or wich conditions. Something was definitely wrong.
